પેઢીનામું, વારસાઈ અને હક્ક કમી: The Official Forms, and What Each One Actually Is

Search for any of these and you get Scribd uploads of somebody else’s filled-in copy. The Gujarat Revenue Department publishes the real forms itself — six of them — and this page tells you which is which and what each one does.

The real thing

The six official e-Dhara forms

These are the application forms the Revenue Department publishes for changes to the record of rights — the 7/12. Each one is listed on the Department’s own e-Dhara forms page with the note “Linked With: RecordOfRight”. We link to the Government’s copy rather than re-hosting them, so you always get the current version.

One form covers two different things. Hakk kami is where a co-sharer gives up their right in the property. Sagir pukhta is where a minor recorded on the 7/12 has reached majority. Do not assume the form is only about one of them.Official PDF →

Two forms that catch people out

Form 3 is not only about relinquishment — it is the same form for a minor reaching majority. Form 5 is not only about death — it also covers entering a right while the holder is alive. And form 6 covers five different transactions on one sheet. Picking the wrong box is the commonest reason one of these comes back.

The one that is not a form

પેઢીનામું — why you will not find it in that list

More people search for a “pedhinamu format pdf” than for any of the six forms above, and then find only Scribd. Here is why: પેઢીનામું is not one of the prescribed e-Dhara application forms. It is a statement of the family tree — who the heirs are and how they are related — drawn up and sworn, and submitted in support of a વારસાઈ application rather than instead of one.

That is why every “official pedhinamu form” you find online is somebody’s own version. The Revenue Department’s treatment of it sits in its circulars rather than its form library — the one that comes up is circular હકપ/૧૦૨૦૧૪/૭૫૬/જ dated 14 May 2014, on the Department’s circulars page. We link it so you can read it yourself rather than take our summary of it.

What a પેઢીનામું has to get right is the part no template can do for you: every heir, correctly named and correctly related. Leave one out, or record a relationship loosely, and the entry that follows is built on it. That is the work.

Read this before you sign

હક્ક કમી is permanent. Please treat it that way.

We will say this more plainly than a form ever will. A હક્ક કમી is a person giving up their share in property. Once it is recorded, getting it back is not a matter of filling in another form — it is litigation, if it is possible at all.

What we will and will not do

We prepare, draft and notarise these documents, and we file them. What we will not do is hand you a fill-in-the-blanks relinquishment template off a web page, because we cannot see your family, your record, or what you are giving up. Anyone who does hand you one, free, on a website, is not carrying any of the consequence.

We are not lawyers. Where a share is contested, where a minor is involved, or where the value is significant, take proper legal advice before signing anything. We would rather tell you that than take the work.

Compare that with a name change, where the worst case is a rejected application and a repeat fee. These are not the same kind of document, and we do not treat them the same way.

FAQs

Pedhinamu, Varsai & Hakk Kami — questions

Is there an official pedhinamu form in Gujarat?

No. Pedhinamu is not one of the prescribed e-Dhara application forms. It is a statement of the family tree, sworn and submitted in support of a Varsai application. Every 'official pedhinamu form' circulating online is somebody's own version.

What is the difference between Varsai and Hakk Kami?

Varsai enters heirs' names on the record of rights, usually after a death. Hakk Kami is the opposite direction - a co-sharer giving up a right they already have. They are different forms and different consequences.

Where can I download the Varsai form free?

From the Gujarat Revenue Department's e-Dhara forms page. It is listed as 'Varsai / hayati ma hakk dakhal karvani arji no namuno' and it is free. We link to the government copy rather than re-hosting it.

Does the Hakk Kami form also cover a minor becoming an adult?

Yes. The official form is titled for both - hakk kami and sagir pukhta, a minor recorded on the 7/12 reaching majority. It is one form for two different situations.

Can I undo a Hakk Kami after it is recorded?

Not by filling in another form. Relinquishing a share is meant to be permanent, and reversing it is a legal matter, if it is possible at all. Take proper advice before signing, particularly where a minor or a contested share is involved.

Will you give me a ready relinquishment template to fill in?

No. We prepare, draft, notarise and file these documents, but we will not publish a fill-in-the-blanks relinquishment template, because we cannot see your family, your record or what you would be giving up.

How do I check what my 7/12 currently says?

On AnyRoR, the official Gujarat land-record portal. It is free.

Are you a law firm?

No. We are a documentation service based in Vadodara, and we are not the Revenue Department either. Where a share is contested or the value is significant, take legal advice.
